Starbucks is being sued by a Texas woman who claims she was burned by a coffee order that wasn’t hers.
Mary Simms filed the claim following an event on April 14, when she drove through a Starbucks drive-thru in Tomball, Texas to make an order.
Simms was told by a Starbucks employee that she had gotten the wrong coffee and stopped her car to return it, according to the lawsuit.
The top fell off and poured over Simms’ lap while she was delivering the order back to the employee, leaving her with first- and second-degree burns.
“Plaintiff did not have knowledge of the dangerous condition and could not have reasonably been expected to discover it prior to this incident,” the lawsuit claims.
Starbucks’ carelessness, according to the complaint, was the primary cause of Simms’ injuries.
Simms filed the lawsuit on Aug. 19, asking for less than $75,000 in damages for lost income, medical bills, and past and future bodily pain and suffering.
This isn’t the first time the coffee behemoth has been sued for burn injuries. After being severely burnt when the cap of her Starbucks coffee popped off, a Florida lady was awarded $100,000 in 2017.
Starbucks has faced numerous complaints in recent years, including a $5 million lawsuit filed by a Chicago woman in 2016 after she claimed the business was overfilling cold beverages with ice.
